HRA Rules Changing from April 1
As per the draft Income Tax Rules 2026, salaried individuals will now have to disclose their relationship with the landlord.
This means if you are paying rent and claiming HRA exemption, you must clearly mention whether the landlord is your parent, sibling, spouse, or any other relative.
This information will have to be filled in Form 12BB.
The aim is to ensure that people do not misuse HRA by showing fake rent payments.
PAN Details Now Mandatory in Many Cases
There is another important rule you should know.
If your annual rent exceeds ₹1 lakh, you must provide the PAN of your landlord.
This helps the tax department check whether the landlord is reporting the rental income in their tax return.
If the landlord does not have a PAN, then you will need to provide their name, address, and a declaration stating that they do not have a PAN.
Why Government is Tightening Rules
Experts say that earlier, many people misused HRA by submitting fake rent receipts or incorrect details.
Now, with the help of digital systems like the Annual Information System (AIS), the tax department can easily match data from tenants and landlords.
This will make it harder to hide incorrect information and improve overall transparency.
Be Careful or Pay Heavy Penalty
If you provide wrong details or make a false HRA claim, your exemption can be rejected.
This means your taxable income will increase, and you may have to pay more tax.
In serious cases, a penalty of 50% to 200% can also be imposed under Section 270A of the Income Tax Act.
Keep These Documents Ready
To avoid any trouble, it is better to keep all documents ready in advance.
You should have:
Rent agreement
Rent receipts
Bank payment proof
Form 12BB
Landlord’s PAN details
If you are paying rent to a family member, make sure they show this income in their tax return.
Only then will your HRA claim be accepted without any issues.
