These days, there is a lot of discussion on social media about “Rent Rules 2026.” Many people believe that the government has introduced new rules for tenants. However, this is not completely true.
These rules are not new. They are part of the Model Tenancy Act (MTA) 2021. The central government has only presented this as a model or guideline. It is up to each state government to decide whether to implement these rules or not.

Security Deposit Limit
In cities like Bengaluru, landlords usually ask for a security deposit of 6 to 10 months’ rent. Under the new framework, this has been limited.
For residential properties, the maximum deposit can be two months’ rent
For commercial properties, the limit is six months’ rent
However, this rule will only apply if your state officially adopts it.
Rules for Rent Increase
Many tenants worry about sudden rent hikes. Under this framework, landlords cannot increase rent whenever they want.
The rent agreement must clearly mention the rent amount and when it can be increased
If a landlord wants to increase the rent, they must give three months’ notice
A tenancy will not be valid without a written agreement
Entry Rules and Tenant Privacy
To protect tenants’ privacy, landlords are not allowed to enter the house without permission.
They must give at least 24 hours’ notice before entering
If a tenant does not leave after the agreement ends, the landlord can charge a penalty of double or even four times the rent

Earlier, rent-related disputes used to take years in court. To solve this problem, the framework suggests setting up:

These will help resolve disputes faster. Some states like Uttar Pradesh and Tamil Nadu have started taking steps to implement these rules. However, in states like Delhi and Maharashtra, older rules may still be followed.
