The latest ruling allows the Trump administration to keep the programme on hold while its legal challenge continues.

The decision was delivered by a three-judge panel of the 9th US Circuit Court of Appeals on October 29, 2026.

It puts the earlier reopening schedule on hold and creates further uncertainty for people waiting to enter the lottery.

The ruling does not permanently cancel the Diversity Visa Programme. The main legal appeal is still pending, and further court proceedings could affect its future.

US Diversity Visa Lottery 2027 Reopening Order Put on Hold

The latest development follows an October 14 ruling by a federal district court, which had directed the US State Department to restart the delayed DV-2027 registration process.

Under the earlier order, the department was required to announce registration details by October 29 and open the application window by November 1.

The registration period was expected to remain open for 30 days.

The lower court had also directed the department to notify selected applicants about their eligibility by December 3.

However, the Trump administration challenged that decision and requested an emergency pause while its appeal was considered.

On October 29, the appeals court granted the government’s request, temporarily suspending the lower court’s instructions.

As a result, the State Department is not currently required to reopen registration according to the earlier November 1 deadline.

Why Did the US Appeals Court Block the Lottery Reopening?

The legal dispute began after the State Department failed to open the DV-2027 registration process on its usual schedule.

Red Eagle Law, a California-based immigration law firm representing Diversity Visa applicants, filed a lawsuit against Secretary of State Marco Rubio in August 2026.

The firm challenged the department’s failure to launch the programme. On October 14, the district court granted a preliminary injunction and directed the government to follow a revised registration timeline.

The administration subsequently appealed that order.

The appeals court concluded that Red Eagle Law had not demonstrated that it was likely to succeed in its case because its financial interest in representing lottery applicants was not sufficiently connected to the purpose of the Diversity Visa Programme.

The judges also noted that the programme was created to encourage immigration from countries with historically low levels of immigration to the US, rather than to support the business interests of immigration law firms.

Importantly, the appeals court did not endorse the State Department’s failure to open registration.

It only decided that the lower court’s reopening order should be paused while the legal challenge proceeds.

Will the US Green Card Lottery 2027 Be Cancelled?

The latest ruling does not amount to a permanent cancellation of the DV-2027 programme. It temporarily allows the government to keep registration on hold while the appeal continues.

The main legal dispute has not yet been finally decided. The appeals court is expected to establish the next steps in the proceedings, while the plaintiff may also pursue further legal action.

Curtis Morrison, owner of Red Eagle Law, has indicated that the firm intends to continue challenging the State Department’s decision.

The firm has also discussed bringing further litigation involving a prospective applicant who could directly challenge the government’s action.

For prospective applicants, this means there is no confirmed reopening date at present.

They should avoid relying on the earlier November 1 deadline unless the government or a subsequent court decision announces a new schedule.

Important Information for Indian Applicants

Indian nationals should understand an important eligibility condition before planning to enter the Diversity Visa Lottery.

People born in India are generally not eligible for the programme because India has historically had high levels of immigration to the United States.

Eligibility is normally determined by the applicant’s country of birth, not simply their citizenship, passport or current country of residence.

There are limited exceptions involving certain applicants who may qualify through a spouse’s country of birth or, under specific conditions, a parent’s country of birth.

These rules depend on the individual circumstances and should be checked against official instructions.

Therefore, an Indian passport holder born in an eligible country may have a different eligibility position from someone born in India.

Living in another country does not automatically make a person eligible.

What Is the US Diversity Visa Lottery?

The Diversity Immigrant Visa Programme, commonly called the Green Card Lottery, was established to provide immigration opportunities to people from countries that have historically sent fewer immigrants to the United States.

The programme makes up to 55,000 immigrant visas available annually, subject to applicable rules and the available allocation.

Selected applicants can pursue permanent residency, provided they meet the remaining eligibility and documentation requirements.

Selection in the lottery does not guarantee a Green Card. Applicants must complete the required immigration procedures and receive a visa before the applicable deadline.

For DV-2027, the registration delay has created uncertainty for eligible applicants worldwide.

Anyone interested in the programme should monitor official announcements from the US Department of State and avoid websites or agents claiming to guarantee lottery selection.
