The change means many eligible applicants can no longer rely on an automatic extension of their Employment Authorisation Document (EAD) while waiting for a renewal decision from US Citizenship and Immigration Services (USCIS).

The development could affect Indian families living in the United States, particularly spouses of H-1B visa holders who depend on employment authorisation to continue working.

Applicants whose existing permits expire before their renewals are approved may face a gap in their ability to work legally.

US Ends Automatic EAD Extensions: Who Is Affected?

The US Department of Homeland Security (DHS) has made permanent a rule that removes automatic extensions of work permits for certain applicants who submit renewal requests on or after October 30, 2025.

The final rule, published in the Federal Register on October 14, 2026, confirms the earlier policy without changes.

Affected groups include H-4 spouses of H-1B visa holders, certain applicants seeking permanent residence through adjustment of status, asylum applicants, refugees, asylees and some beneficiaries of Temporary Protected Status (TPS).

The exact impact depends on the applicant’s immigration category and any applicable exception.

Previously, eligible applicants could receive an automatic extension of employment authorisation for up to 540 days while USCIS processed their renewal applications.

Under the revised rule, filing a renewal application on time is generally no longer sufficient to extend work authorisation automatically for the affected categories.

Why the New EAD Rule Matters for Indian Families

Many Indian professionals in the United States hold H-1B visas, while their spouses may qualify for H-4 status and apply separately for employment authorisation.

For families that depend on two incomes, a delay in renewing an EAD could affect household finances and career continuity.

If an affected applicant’s existing EAD expires before USCIS approves the renewal, the person may have to stop working until new employment authorisation is granted, unless another legal basis permits them to continue working.

This can create difficulties for both employees and employers when renewal applications remain pending.

The final rule does not remove the underlying eligibility of H-4 spouses or employment-based green card applicants to apply for work authorisation.

Instead, it removes the general automatic extension previously available to certain applicants while their renewal requests were being processed.

What Happens to Pending EAD Renewal Applications?

Applicants should distinguish between the date they submit a renewal request and the date their existing work permit expires.

Under the revised policy, a timely filing alone generally does not provide an automatic extension for covered applications filed on or after October 30, 2025.

The rule also acknowledges that processing delays can leave some applicants waiting beyond the expiry date of their current permits.

DHS says the policy is intended to ensure that continued employment authorisation follows updated eligibility checks and screening, even though temporary gaps in work permission may occur.

Applicants should review their EAD category, expiry date and renewal status, and seek qualified immigration advice if they are unsure whether an exception applies.

Employers should also verify work authorisation in line with applicable requirements rather than assume a pending renewal automatically allows continued employment.

Are F-1 STEM OPT Students and L-2 Spouses Affected?

The changes do not eliminate every form of work authorisation extension. Eligible F-1 students who timely file for a STEM OPT extension continue to have a separate 180-day automatic extension under the applicable rules.

This is distinct from the general 540-day EAD renewal extension that has been removed for the affected categories.

Certain L-2 and E spouses may also be authorised to work based on their immigration status rather than relying solely on a separate EAD card.

Their circumstances differ from those of H-4 spouses, so applicants should check the rules that apply to their specific status and documentation.

The key point for Indian workers and families is that the final rule changes how certain EAD renewals are handled, not the basic eligibility to apply for a permit.

Checking the relevant category and renewal timeline is essential to avoid unexpected interruptions in employment.
