The extension provides more time to settle cases under the existing rules without going through lengthy court proceedings.

The scheme was originally scheduled to close on September 30, 2026.

Following requests from various stakeholders, ESIC has extended it from October 1 to December 31, 2026, without changing its existing terms and conditions.

Why Has the ESIC Amnesty Scheme Been Extended?

The New Amnesty Scheme 2025 is a one-time dispute resolution initiative introduced to reduce the backlog of court cases and encourage compliance under the erstwhile Employees’ State Insurance Act.

The extension follows representations made by different stakeholders seeking additional time to resolve pending matters.

The Labour Ministry said the move would give eligible employers and insured persons another opportunity to use the scheme.

Under this initiative, employers can seek an out-of-court settlement of certain disputes with ESIC through a structured process.

It is intended to reduce litigation while helping establishments address outstanding compliance issues.

What Benefits Does the ESIC Amnesty Scheme Offer?

The scheme provides relief in specific types of disputes, subject to the prescribed conditions.

One provision allows employers to settle ad-hoc assessments by paying the actual contribution amount along with applicable interest. No damages will be levied in such cases under the scheme.

Another provision covers cases in which employers have already paid their outstanding dues.

Such cases can be withdrawn, subject to payment of 10% of the disputed damages.

The scheme also provides a route for withdrawing certain cases filed by ESIC over non-submission of records or delayed payments.

This applies where employers have subsequently completed the required compliance, with withdrawal subject to court permission.

These provisions are intended to help eligible parties resolve disputes without continuing lengthy legal proceedings.

Which Pending Cases Are Eligible?

The scheme covers eligible court cases filed up to March 31, 2025.

Employers and insured persons should check whether their pending matters fall within the categories and conditions specified under the scheme.

The extension does not mean that every dispute with ESIC automatically qualifies.

Eligibility depends on the nature of the case, the payments already made and the compliance requirements applicable to that matter.

Employers should review their case details and the relevant scheme guidelines before seeking settlement or withdrawal.

What Is the Last Date to Apply?

The extended window for the New Amnesty Scheme 2025 runs until December 31, 2026.

Eligible employers and insured persons can use this additional period to pursue settlement under the existing conditions.

The ESIC Amnesty Scheme extension is effective from October 1, 2026, and does not introduce a new set of benefits or revised settlement terms.

The original conditions continue to apply.

Stakeholders who may qualify should review their pending cases and take the necessary steps before the deadline.

They can refer to the detailed scheme guidelines and contact the relevant ESIC office for information about the applicable procedure.
