Pension Funds Now Liable for Third-Party Errors

The Pension Fund Regulatory and Development Authority (PFRDA) has introduced a major rule change to strengthen the protection of National Pension System (NPS) subscribers.

Under the new rules, pension funds will now be fully responsible for any mistakes made by third-party companies they hire to provide services.

Even if an external agency is involved, the pension fund cannot avoid accountability. The new regulations came into effect on July 13, 2026.

Pension Funds Will Be Fully Accountable

To bring this change into effect, PFRDA has amended the Exits and Withdrawals Regulations, 2015 by adding Regulation 4A.

The new regulation allows pension funds to outsource certain services to external agencies. However, it clearly states that outsourcing does not reduce the pension fund’s responsibility toward subscribers.

If a third-party company makes an error, acts negligently, or causes any loss, the pension fund will be legally and financially responsible.

New Rules for Third-Party Service Providers

PFRDA has also introduced strict eligibility conditions for external service providers.

These companies must have the technical capability to connect with pension funds and other PFRDA-registered entities, including the Central Recordkeeping Agency (CRA).

This will help ensure smooth data sharing, pension benefit payments, and other subscriber-related services.

Both the pension fund and the external agency will remain under PFRDA’s direct supervision and must follow all applicable laws and regulations.

PFRDA Launches Regulatory Sandbox Framework

Along with these changes, PFRDA has also introduced the Regulatory Sandbox Regulations, 2026.

The new framework will allow companies to test innovative products, services, business models, and technology solutions in a controlled environment before launching them on a larger scale.

During the testing phase, PFRDA may provide limited regulatory relaxations if required, making it easier for companies to develop new ideas while ensuring subscriber safety.

These latest measures show that PFRDA is focusing on stronger customer protection while encouraging innovation in India’s pension sector.
